1. DEFINITION AND OBJECT OF THE CONTRACT.
1.1 - This "contract" is a distance contract pursuant to art. 50 and ss. Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). The Contract concerns the sale of movable property between Dissegna Sports Distribution srl, with registered office in S. Giuseppe di Cassola - 36022 - Via Papa Giovanni Paolo II, Vicenza Company Register number, R.E.A. VI-337006, P.I. 03584300242 ("Disport") and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Disport of a purchase proposal issued by the Customer by telephone, via the internet, on the website www.disport.it (the "Site") and / or through other systems of distance selling of Disport, based on the methods described in article 3 below.
1.2 - These general conditions of sale ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by Disport, repeated on the phone to the Customer and shown on the Site, will remain valid and effective until they are modified and / or integrated by Disport. Any changes and / or additions to the General Conditions will be effective from the date on which they will be communicated to the public and will apply to sales made from that date. The latest updated version of the General Conditions is the one available on the Site.
2.1 - The sales prices of the products illustrated on the Site and / or through any other Disport remote sales systems include VAT and any other tax.
Delivery costs are indicated on the Site and / or through any other Disport remote sales systems and, in the case of a telephone order, repeated to the Customer by the Disport operator.
3. PURCHASE AND PAYMENT METHODS.
3.1 - The Contract by telephone is finalized by communicating to the Customer (who has contacted Disport by telephone and formulated, on that occasion, a purchase proposal, also providing the operator with the data necessary for the procedure for registering his name, purchase order and payment method chosen) that the proposal is accepted.
3.2 - In the event of purchase proposals sent through the Site, the Customer will receive a summary e-mail fromDisport, with which he will be informed that his purchase proposal is being processed and will be considered accepted, unless otherwise communicated e- mail or telephone sent by Disport within 3 (three) working days from the receipt of the summary e-mail. Once this term has elapsed, the Agreement via the Internet is to be considered completed.
3.3 - The customer will be allowed to choose one of the following payment methods:
3.3.1 by advance bank transfer, made by the Customer at the time of ordering by sending a copy of the transfer to Disport by fax to 0424 811387 or by email to firstname.lastname@example.org, which contains CRO number, beneficiary value date, general orderer and reason for the transfer. 3.3.2 by credit card; The payment made by CREDIT CARD is not automatically collected at the end of the transaction, but after the verification by Disport of the willingness to fulfill the entire order. Transactions take place directly through the PayPal service and the transfer of data takes place via 128 bit SSL3 encryption. Any changes to the order or cancellations of the same, with the consequent modification and / or cancellation of the payment by credit card, can be accepted by Disport within 3 hours of the order being made or before the order has been processed with the wording "SHIPPED" In the field indicating the status of the order within the reserved area accessible only to users registered on the site www.gasprovanes.com.

4. DELIVERY OF PRODUCTS - TIMING - COMPLAINTS.
4.1 - Shipping costs are automatically calculated based on weight / volume and number of packages by an automated calculation system that will provide the cost estimate at the end of the order before sending it to Disport. This calculation of the sum is not entirely binding as other factors may arise such as additional cost to reach disadvantaged locations, for delivery to floors, for delivery to large distribution centers, for delivery by appointment or for calculation errors of the computerized system . The automatic sending of the order confirmation is not in fact a confirmation of the actual cost of shipping.
4.2 - Disport delivers the products to the address indicated by the Customer within the maximum time of 30 (thirty) days from the conclusion of the Contract.
4.3 - The delivery times indicated at the time of selecting the shipping cost (Express and PT Light) are to be considered indicative and not contractually binding as unforeseeable factors may arise at the time of the conclusion of the contract with the customer and / or at the time of conclusion of the contract with affiliated shippers.

5. AVAILABILITY OF PRODUCTS.
5.1 - Disport accepts customer orders within the limits of the quantities of products actually in stock. Therefore, the acceptance by Disport of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. Disport undertakes to promptly notify the Customer of any unforeseen depletion of stocks due to excess demand or other causes. Availability is indicated on each product page by a round red symbol = not available, yellow = good availability, green = excellent availability. These data are updated automatically every 10 minutes except for complications on the telephone line. The availability visible on the website www.gasprovanes.com in the product sheet is not binding on the actual presence of the product in the warehouse.
In the final part of the order, the customer will be asked to specify if he wishes to receive the products available in the warehouse and later those that Disport will have to obtain, or if he wishes to receive the shipment as soon as it is complete with all the products ordered.
6. WARRANTIES AND ASSISTANCE.
6.1 - For products purchased by the Customer, the rules on guarantees and assistance relating to the sale of consumer goods are applicable to Disport. In any case, to take advantage of the warranty service, it is necessary to fill in the assistance form that can be downloaded from the following link, following the instructions in detail.
6.2 - The customer will not be able to take advantage of the guarantee in cases where the product has been modified and / or tampered with, does not have all the characteristics of the original product, has obvious signs of improper use (such as a shot without arrow for bows / leaf springs) and excessive wear compared to the normal use of the product and addition of accessories that may have caused stress to the product. In any case, the warranty is intended only for the first owner of the product.
6.3 - The shipping costs, unless otherwise agreed by the parties, are charged to the customer.
7. CUSTOMER OBLIGATIONS.
7.1 - The Customer declares and guarantees: (I) to be a consumer according to the provisions of art. 3 of the Consumer Code; (II) to be of age; (III) that the data provided by the same for the execution of the Contract are correct and true.
8. RIGHT OF WITHDRAWAL.
8.1 - The Customer has the right to withdraw from the contract stipulated, without any penalty and without specifying the reason, within 14 days from the receipt of the products (as per Legislative Decree N 21 of 21/02/2014).
The Customer may exercise the right of withdrawal, within the aforementioned term, by expressing it by means of a communication, by registered letter with return receipt sent to the Disport headquarters pursuant to art. 4, or by opening a return request using the appropriate online assistance form at www.disport.it/support. The Customer will receive as soon as possible the instructions to exercise the right of withdrawal and return of the purchased product.
8.2 - Pursuant to article 59, the customer will not have the right of withdrawal in the following cases:
- for the provision of services whose execution began, with the agreement of the consumer, before the expiry of the seven-day term.
- for the supply of goods or services, the price of which is linked to fluctuations in financial market rates which the supplier is unable to control.
- for the supply of goods made to measure or clearly personalized or which, by their nature, cannot be sent back or risk deteriorating or altering rapidly.
- for the supply of sealed audiovisual products or computer software, opened by the consumer.
- for the supply of newspapers, periodicals and magazines for betting and lottery services.
8.3 - If the customer has received the product, please return it to Dissegna Sports Distribution srl without undue delay and, in any case, within 14 days from the day on which it communicated the withdrawal. The deadline is met if the Customer returns the goods before the expiry of the 14-day period. The costs of returning the products are charged to the customer. Disport will reimburse, including shipping costs (with the exception of the additional costs deriving from the possible choice of a type of delivery different from the less expensive type of standard delivery offered and from the possible choice to pay cash on delivery), within 14 days from date of receipt of the products by the Customer. The refund amount may vary based on the following cases:
- it will be complete in case of return of the intact goods in the original and sealed packaging;
- will be no more than 70% of the value of the purchased good in case of return of the product no longer sealed;
- will be subject to evaluation in case the product returned by the Customer has been consumed in an appreciable way and / or such as to significantly diminish its value. In this case, Disport will replace only the part of the price equivalent to the product actually received.
These refunds will be made using the same payment method used by the customer for the initial transaction, unless the customer requests a refund on a different payment method, in which case any additional costs deriving from the different payment method chosen will be charged to the customer. by the customer. The refund can be suspended until the goods are received or until the Customer has demonstrated that he has sent the goods back.
8.4 Returned by default or non-compliance
If the Customer has received an incorrect or damaged product, please contact our Customer Service to request the return authorization by sending the completed form in its entirety, and attaching a photographic proof. You can do it through the contact form or by writing to email@example.com. Disport will send a confirmation email with instructions for shipping and indications for replacing or refunding the purchased item.
9.1 - The Contract is governed by Italian law. Any civil dispute relating to the application, execution, interpretation and violation of the Contract will be the responsibility of the judge of the place of residence or domicile of the consumer, if located in the territory of the Italian State (art.66-bis).
10.1 - These General Conditions have been conceived in Italian. The Italian version, therefore, has a prevalent weight and is the only one to be considered binding. The English text must be treated as a courtesy translation of the Italian text.
